Welcome to Twill Creative, Inc. We look forward to working with you. This document outlines the terms and conditions that govern our design services, as discussed during our initial consultation. Please review carefully and feel free to reach out with any questions or concerns.

Scope of Work:

Twill Creative, Inc. provides creative services including—but not limited to—branding, logo design, website design, and custom design deliverables tailored to your needs.

Deliverables:

The final deliverables for this project will be outlined in a separate proposal. These may include design files, branding guidelines, and other agreed-upon materials.

If a service or deliverable has been discussed but is not included in the proposal or this agreement, please bring it to our attention, as the scope of work is limited to the services explicitly documented.

All final deliverables will be provided upon receipt of full payment, subject to the terms outlined below.

Timeline:

Project timelines will be detailed in the project proposal. Any changes or delays will be communicated in a timely manner.

Ad Hoc or Hourly Work

For small or ongoing design needs, we often work on an hourly basis. You’ll receive a written estimate via email based on the scope of work you describe.

We do our best to stay within the estimated range, but actual hours may vary depending on factors such as revision requests, changes to scope, or unexpected technical needs. If we anticipate exceeding the original estimate, we will notify you before proceeding.

Fees and Payment:

Fees will be based on either an hourly rate or a flat project fee, depending on the nature of the work. Estimates will be outlined in writing, typically via email or formal proposal.

Proposal pricing is valid for 30 days from the date of issue. Final project costs are subject to change under the following conditions:

  • If work is requested beyond the original scope

  • If external vendors or third-party fees (such as printing or licensing) change

  • If delays or revisions outside our control affect time spent on the project

Should we anticipate a change in scope or cost, you will be notified as soon as possible.

A deposit may be required prior to the start of work. Upon completion, the final invoice will reflect the remaining balance plus any approved overages or additional work.

Intellectual Property:

Upon full payment, you will own the rights to all final design deliverables. Twill Creative, Inc. retains the right to showcase portions of the work (excluding any materials you identify as confidential, privileged, or proprietary) in our portfolio, website, or other promotional platforms.

Revisions:

Unless otherwise stated in the project proposal:

  • For graphic design work (e.g. logos, layouts, mockups), you will receive 2–3 initial concepts.

  • Two (2) rounds of revisions are included after concept selection.

  • For additional deliverables, two (2) rounds of revisions are included post-approval of initial designs.

Additional revisions or new deliverables outside of the agreed scope will require a separate estimate and approval.

Communication:

Termination:

Either party may terminate this engagement with written notice in the event of a material breach. Payment will be required for all work completed up to the termination date.

Confidentiality:

All project-related information will be treated as confidential and will not be shared with third parties without your prior consent.

Governing Law:

This agreement shall be governed by the laws of the State of New York..
