Welcome to Twill Creative, Inc.! We're thrilled to embark on this creative journey with you. This page outlines the terms and conditions of our engagement for design services as discussed during our initial consultations. Please review this document carefully, and let us know if you have any questions or concerns.
Scope of Work:
Twill Creative, Inc. provides a range of creative design services, including but not limited to branding, logo design, website design, and other custom design solutions tailored to your specific needs.
Deliverables:
The final deliverables will be as detailed in the project proposal and may include design files, branding guidelines, and any other agreed-upon materials.
If we have discussed a service or deliverable previously but you don’t see it included in the project proposal or in this agreement, please raise this with me, as the scope of this engagement will be limited to the documented services and deliverables.
All relevant files for deliverables will be provided once payment has been made in full, subject to the balance of this agreement.
Timeline:
The estimated timeline for the completion of the project is outlined in the project proposal. Any changes to this timeline will be communicated promptly.
Fees and Payment:
I calculate my fees based on the scope of work discussed during an initial consultation meeting. My fees, either a fixed project price or an hourly estimate, are outlined in the project proposal.
Prices in the project proposal are valid for one (1) month from the date of issue. The total project cost is subject to change in the following circumstances:
if time spent exceeds the estimate due to factors outside of my control, including due to instructions by you to complete work outside of the initial scope, or
if third parties which I engage on your behalf modify their fees.
If I anticipate the project cost to exceed the estimated amount, I will inform you as soon as possible.
Detailed payment terms are outlined in the project proposal. I may, at my discretion, require a deposit based on a percentage of the total project cost.
Upon project completion, I will invoice you for the remaining project costs plus any unforeseen expenses and work completed outside of the proposal.
Intellectual Property:
Upon receipt of full payment, all rights to the final designs and deliverables will be transferred to you, but you will grant me the right to use portions as examples on my own platforms to promote the business in a portfolio format to procure more work, except any content that you deem to be confidential, privileged, or proprietary.
Revisions:
If the deliverables include graphic design works, such as a logo, layout, or mockup, I will provide 2-3 concepts for review and selection. Once you’ve made your selection, two (2) revisions to the design (such as color variations) are included. Once the initial design is approved, two (2) revisions are included for any other deliverable items. Any deliverables or revisions above and beyond what is included here will be subject to further agreement and fees.
Communication:
We value open communication. Any questions, concerns, or feedback should be directed to Alexis Winslow at alexis@twillcreative.com.
Termination:
Either party may terminate this engagement with written notice if the other party breaches any material term or condition.
Confidentiality:
All information shared during the project will be treated as confidential and will not be disclosed to third parties without prior consent.
Governing Law:
This agreement shall be governed by and construed in accordance with the laws of New York.
